HAVE YOU BEEN CONTACTED BY THE CALIFORNIA DEPARTMENT OF CONSUMER AFFAIRS?

If you a reading this, you are likely a licensed professional who has recently been contacted by the Department of Consumer Affairs for California. You may be confused, anxious, or irritated, by being contacted. This is most likely the first time you have ever been contacted by the Department of Consumer Affairs, and prior to being contacted, you might have not even known that the Department existed. However, being contacted by the Department of Consumer Affairs should not be taken lightly.

By their own words, the California “…Department of Consumer Affairs consists of 36 boards and bureaus that regulate over 3.4 million licenses in more than 250 various professions and occupations…”

Department of Consumer Affairs Enforcement

This means that if you are a professional or, have an occupational license, you were governed by the Department perhaps without evening knowing it!

However, when dealing with the Department of Consumer Affairs, your first contact will often not be with the Department of Consumer Affairs itself but by a branch known as the Division of Investigation (DOI). The Division of Investigation (DOI) can be thought of as a prosecutorial branch.

Being contacted by the Department of Consumer Affairs and especially by one of the investigators for the Division of Investigation should not be taken lightly. The name “investigator” is a rather harmless and misleading title. “Investigators” are actually peace officers (colloquially, “police officer”) pursuant to California Penal Code §830.3(a). This means that when being contacted, or questioned, by the Department of Consumer Affairs, or its Division of Investigation, you should treat their contact as the same as if the police came knocking on your door.

Would you talk to the police, without a lawyer, if you were under investigation?

If not, then you might not want to talk to the Department of Consumer Affairs or an “investigator” with the Division of Investigation without a competent attorney by your side.
